MAKING DECISIONS!

I've had a rough week. There's no sugar-coating it. It was just one of those weeks. I had to make some tough decisions and it was just rough. We all have those weeks.nuts

But I made the decisions, I stayed focused and I'm now working through the remainder of the difficult details. I'll post another blog in a few days with more information, but I felt the need right now to share with my Active Rain support group. (Didn't you know that's what this was?)

 

I guess I'm patting myself on the back a little bit because there have been times in my life when I was paralyzed with fear and wouldn't make any decisions. And there have been times in my life when I was in a comfort zone and didn't want to change anything. Either of these mind-sets can be detrimental to your business, your relationships, and your life.

Not making a decision, is a decision!

Life is a series of changes. If we refuse to change, we get left behind. It's through change and adversity that we learn, grow and mature. Right now, I'm out of my comfort zone. It's a little bit scary, but that's a good thing! I now have huge opportunities ahead. And I'm looking forward to them.

We all have days when we're feeling down or discouraged. But successful people are the ones who don't stay in that frame of mind. It's self-defeating. I've discovered that successful people each have their own way of breaking those self-defeating thoughts and feelings. For me, I first have to identify the lie (that's what it is). And my solution is always scriptural.

Here are some of God's promises that encourage me and keep me on track.

  1. For I know the plans I have for you declares the Lord. Plans for good and not evil. To give you hope and a future.
  2. For God did not give us a spirit of timidity (of cowardice, cringing or fear), but He has given us a a spirit of power and of love and of a calm and well-balanced mind, discipline and self-control.
  3. I can do all things through Christ who strengthens me.
  4. For the Lord has given us the ability to produce wealth.

I'll probably elaborate on this more, in a future post. But I'm interested in how you keep yourself motivated. SETTING A GOOD EXAMPLE aka HELPING OTHER REAL ESTATE AGENTS

I just read a post by Jacob Morales, called What's In It For Me? where he relayed the story of an arrogant Top Producer who treated him in an offensive manner when he needed her help, in the early stages of his career. I recommend you read his post as an opposing balance to this one.

As with most Realtors, my first year in the business was rocky. I didn't make much money and had amassed enough debt to have me pretty stressed out.  And the sales manager was not only no help, this manager actually helped me to LOSE a much-needed, double-sided sale.

On the flip-side, one of our top producers always went out of her way to ask me how I was doing and offer advice and assistance.  I quickly learned to call her instead of the manager when I needed help. And she always freely gave it!

Right around the one-year mark, I got a floor call from a buyer in the million dollar range. I successfully closed on a $1,200,000 house. I paid off all my debt and established myself in the community. It was the beginning of my success in this industry.

 

But what ended up being one of the most memorable happenings was what happened after-the-fact. I came into the office one day and pulled the handful of miscellaneous advertisements, recruiting offers and industry publications out of my mailbox and found a small envelope. In the envelope was just a little card from the agent that had always helped and encouraged me. It said "Hooray for you. Congratulations on your big sale. You deserve it!"

Was that a big deal? Actually, yes it was. And I'm not a sentimental person! It's really one of my weaknesses. But that small gesture stuck with me; So much so that a couple of years ago, when management decided to hire a slew of new agents all at once, after the first few months had gone by and their excitement had worn off, I could see their discouragement starting to creep in. So I decided to take it a step further. I hand-wrote an encouraging note card to EVERY agent in my office (around 60). I even gave them to the older ones and those who produced more than me. The idea was to promote unity and a helpful environment. And it worked!

Several of those struggling newbies went out of their way to tell me that my little note meant a lot to them and that it was a huge encouragement to them . They also said that they intended to do the same thing for others when they became more successful. (Kinda reminds me of that movie, "Pay It Forward".) Well guess what? They're now in the position to help the newer agents. And I've seen them doing it! See how little it takes to create a great work environment for everyone? And it starts with you!

To repeat what I said at the end of my post titled How Well Do You Listen?, "People don't remember what you say. They remember how you make them feel." I want to make people feel good about themselves. It's about walking the talk.

SmokeriseI keep wondering, when I bring buyers to see a house, and compare the house itself, to the Daytona Beach MLS information, why I see not just discrepancies and mistakes, but sometimes what can only be defined as downright laziness on the part of the listing agent.

A couple of days ago, while showing several houses, I found

  • One that had no mention of the garage!?!
  • One that had only 3 photos of a gorgeous home, when The Daytona Beach area Multiple Listing Service holds 12.
  • One that had no mention of the pool ??
  • One that had no mention of the new granite counters, solar hot water heater, and place to store your boat behind the side-yard fence.

laughing smileyOne of my biggest issues is with lazy agents who don't write a thorough description of the property. I mean, I can understand if it's a REAL fixer-upper (like one of Rich Kruse's listings, yeah I went there) and the listing agent is having trouble finding some positive light to shed,  but these were upscale, beachside (meaning on the peninsula, or strip of land between the Atlantic Ocean and the Intracoastal Waterway) single family homes. Just walking through with my buyers, I found plenty of  things that should have been mentioned in the MLS descriptions. 

Why is it that some real estate agents are OK with providing sub-standard service to their sellers? Do they have so many listings that it just doesn't matter? As a professional, I consider these things to be the minimum level of service. I feel like I owe it to my clients to do EVERYTHING in my power to present their most valuable possession in the most positive light, in order to place them ahead of the competition. After all this is a buyer's market and we have unprecedented levels of listing inventory in our MLS right now.living room

PLAN A FUN OUTING IN PORT ORANGE FLORIDA

Being a native of the Daytona Beach and Port Orange area, it's easy for me to forget how much fun can be had, in such a close proximity to my home in Port Orange. Just a 5 minute drive from my home, is not only the beautiful Atlantic Ocean, but some great restaurants and public docks, underneath the Dunlawton bridge.

This weekend, my husband and I decided to have a casual dinner at Our Deck Down Under.view of docks and birds on Intracoastal Waterway

This Port Orange restaurant is located directly on the Intracoastal Waterway, with indoor and outdoor dining. I had a full pound of delicious crab legs.

 

After dinner we took a walk around the area and ran into family and friends, while enjoying the tranquil views and relaxing environment.

I found these unique paintings right on the outside walls of the restaurant! I love the lobster. He looks so cool just hanging there on the net. I just had to share some of these photos with you all! Port Orange and Daytona Beach are absolutely beautiful! But we sometimes forget where to look.

There are two other fresh seafood restaurants located in this little haven under the bridge.

King's Seafood is another Port Orange restaurant under the Dunlawton bridge, that has beautiful artwork painted directly on the building, including a mermaid, King Triton, a heron catching a fish, and a leatherback turtle that is very close to making it OFF the endangered species list!

UPDATE ON NEW PORT ORANGE WAL MART SITUATION

Wal MartFor quite some time now, Wal Mart has been seeking approval from our City Council, to construct a Supercenter at the corner of Nova Rd. and Madeline Ave.

On the surface, to some people, this may seem like a great idea; except for the fact that there are already two Wal Mart Supercenters, within 3 miles from this location. Not to mention the fact that Nova Rd. was just widened a couple of years ago, to accommodate the traffic that had by far, out-paced what that road could handle. To build another (unneeded) Wal Mart would once again put too much demand on that section of Nova Rd., as well as lower the property values in the surrounding neighborhoods.

At the February council meeting, the city council members decided to allow Wal Mart to construct a Wal Mart Neighborhood Market store, which is much smaller than a Supercenter, but still quite large. However, the Neighborhood Market chains also sell gasoline, and this particular parcel of land has an ammonia plume running beneath it. The plume is originating on another lot, and running beneath this one as well. The owner of the other lot is willing to clean up the ammonia that is originating beneath his lot, but is not responsible for what is running beneath the lot that Wal Mart has purchased.Cash

Wal Mart, of course, wants to make as much money as possible, and they are not interested in constructing a smaller chain with the added negative of not having the gasoline revenue.

In the March council meeting, all plans submitted by Wal Mart were unanimously voted down by the council members. This was great news for the residents of the neighboring communities, located Semi Truckdirectly behind this parcel, who have been circulating petitions against the Wal Mart plans, since the onset of their submission.

 Consider if you will, having the noise of large trucks making deliveries all night, huge spotlights in the parking lot, heavy traffic on the small, neighborhood roads in front of their subdivisions, and traffic jams on a road that just recently started running smoothly.

As it has been left, unless Wal Mart agrees to the Neighborhood Market store, with no gas pumps, their plans for this location are officially rejected.

Governor Crist has declared a State of Emergency for all of Florida

We now have mandatory "burn bans" in some areas and the smoke is thick at my own house, which is about 30 miles from the closest burn site.

15 new fires broke out today! I spoke with a family member who lives in Jacksonville (approximately 100 miles north of us), and was told the smoke is extremely dense there, since they have fires to the north and south of them. If the wind shifts, they just get hit from another direction.

How Realtors Represent Their Clients; The Legalities

beach and palmsThis is a difficult topic to explain to buyers and sellers. The laws differ from state-to-state, so this article will only apply to the state of Florida.

  • Let's start with the basic foundational rule that the broker of a real estate company, owns all the listings (seller's interests) and sales (buyer's interests) that are processed through that company.
  • Next to be built upon that foundation is, the broker (and every agent who works with that broker) cannot represent the best interests of the parties on opposite ends of a transaction.business clipart

Home Buyers: When you call a Realtor to ask about a particular listing or listings, you should be aware of whom that Realtor is representing. If you've called the listing agent, that Realtor may be representing the seller in the form of "Single Agent" and is working in the best interests of the seller.

However, in the state of Florida, as soon as a listing agent, or anyone in that same brokerage, begins to work with a buyer on that particular property, they can no longer represent the seller or the buyer as a "Single Agent".  They must now transition to a "Transaction Broker" relationship, which in the simplest terms means, they now represent the "Transaction" to a certain extent. They can now work with both the buyer and the seller, in a neutral capacity. But neither of these types of representation will allow the agent to disclose any privileged information to the opposite party.

Home Sellers: Keep in mind how these laws effect you.  If the agent who listed your property, along with any agent who works at the brokerage with whom you're listed, produces the buyer for your home, they may  not represent your interests above the interests of your buyer. It's the law. The agents at that brokerage must remain neutral.

Does it sound unfair? Maybe. But remember, under no circumstances may your agent disclose your confidential information to the other party. (Details are below)

In the state of Florida, the only way to have the representation of a "Single Agent" is if the listing and selling agents work for different brokerage companies. In that case, there can be a Seller's Agent and a Buyer's Agent.

Be prepared for this though. The Florida Association of Realtors is planning to do away with all forms of Single Agency within the next couple of years. Already, about 95% of the real estate brokerages, only offer the representation of "Transaction Broker".  The reason? Less liability for the brokerage. As a single agent, what a listing agent says to a buyer, and vice versa, can be assumed to be directly from the mouth of the seller or buyer, which means the agent can be sued for misrepresentation, even though the seller or buyer may have given false information to the agent. And since the agents often have no way of knowing if the information is false, the only alternative is to not function in a capacity that allows the agents to speak directly for the client. There has to be absolute honesty and trust for this representation to be advantageous to the client or the agent.

Now let's compare the differences in these two types of representation. Here is the verbiage of these relationships.

  1. Dealing honesty and fairly

  4. Obedience
  5. Full disclosure

  7. And additional duties that are entered into by this or by separate written agreement.

Limited representation means that a buyer or seller is not responsible for the acts of the licensee. Additionally, parties are giving up their rights to the undivided loyalty of the licensee. This aspect of limited representation allows a licensee to facilitate a real estate transaction by assisting both the buyer and seller, but a licensee will not work to represent one party to the detriment of the other party when acting as a transaction broker to both parties.
